 REGISTRATION

ELIGIBILITY TO PURCHASE

To make purchases on the Site, you must provide your personal details including your real name, date of birth, phone number, email address, and other required information. Additionally, you need to provide valid and accurate payment details, confirming that you are the person named in the billing information. You must verify that you are 18 years of age or older to complete the purchase process. Orders from individuals under 18 years of age will not be processed. We may limit the quantity of items shipped to a single customer or postal address.

LEGAL NOTICE

Cellar Drive supports the responsible service of alcohol. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. All orders supplied under Liquor Licence LIQP770018178.

ORDERS

All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers. We seek to only offer products for sale that are in stock and available for dispatch within a reasonable period of time. Occasionally however, we may be waiting for additional stock from our suppliers. Should this occur, we shall seek to notify you of the expected delivery date and you will be given the opportunity to refund your purchase if so desired. Cellar Drive will store a record of your transactions for a minimum of three years.

ACCEPTANCE OF YOUR ORDER

  1. Order Confirmation: Upon placing your order, you'll receive an email confirming its receipt. Please note that this email does not signify acceptance of your order; it's simply an acknowledgment. Your order is officially accepted once we dispatch the goods. The contract is finalized in New South Wales, Australia.

  2. Order Acceptance: We reserve the right to reject your order if we encounter issues such as payment authorization, shipping restrictions, item unavailability, or failure to meet our quality standards.

  3. For Personal Use Only: All purchases are intended for personal use only. We may cancel orders intended for commercial resale.

  4. Pricing Accuracy: While we strive for accurate pricing, discrepancies may occur. If you order an item with a pricing error, we reserve the right to cancel the order.

  5. Refusal of Service: We may refuse service or cancel transactions at our discretion. We're not liable for withdrawing merchandise, editing content, or canceling transactions, regardless of sales status.

PAYMENT

You can pay with Visa or MasterCard, as well as other methods advertised on the site. Your payment will be charged when your order is dispatched by Cellar Drive. By using a credit/debit card, you confirm it's yours or you have permission to use it. All card transactions are subject to validation and approval by the issuer. If your card issuer refuses payment to Cellar Drive, we're not responsible for any delays or non-delivery.

LOST or DAMAGE

Responsibility for any damage, loss, or breakage to products transfers to you upon delivery, as confirmed by the 'Proof of Delivery' documentation provided by our designated shipper. Therefore, we won't offer refunds for products damaged after delivery. If you choose the 'Authority to Leave' option during checkout, Cellar Drive isn't responsible and doesn't provide warranties for loss or damage, whether due to theft or breakage.

INTELLECTUAL PROPERTY RIGHTS

Using the Site and its contents doesn't give you any rights to copyright, designs, trademarks, or other intellectual property related to the Content. This includes our Software and all code on the site. All such Content, including third-party trademarks, designs, and related intellectual property rights, is protected by national and international laws. You're allowed to use the Content only as authorized by Cellar Drive. Reproducing or redistributing the Content is prohibited and may result in legal penalties.

YOUR ACTIVITY

You are personally responsible for how you use this Site and for all your communication and activity on it. If we find that you're involved in prohibited activities or disrespectful behavior toward other users, we may temporarily or permanently deny you access to the Site.

LIABILITY DISCLAIMER

Cellar Drive provides the Site in good faith, but we do not make any warranties regarding the Site or its Content, or any linked websites. We exclude all warranties permitted by law. The Site's contents are not advisory and should not be the sole basis for any decisions.
